These Terms of Use are governed by the law applicable to the State of Queensland and the parties submit to the exclusive jurisdiction of the courts of that State.
No delay, neglect or forbearance on the part of the Condamine Alliance in enforcing these Terms of Use will be, or deemed to be, a waiver. Nor will it prejudice any rights of the Condamine Alliance.
By using this Condamine Alliance Regional Catalogue ('the Catalogue') and the Content available on and through it, you are agreeing to be bound by these Terms of Use and the Privacy Policy.
Content that you access through the Catalogue may also be subject to specific terms and conditions imposed by a data provider (Data Provider Terms). These Data Provider Terms may include certain licences to use the Content, such as Creative Commons licenses.
The Data Provider Terms and the Terms of Use form the legally binding agreement between you, the Condamine Alliance and/or the data provider. If there is any inconsistency between these Terms of Use and the Data Provider Terms then the Data Provider Terms will prevail, but only to the extent that it applies to the particular Contents and to the extent necessary to resolve any conflict.
We may change these Terms of Use or a data provider may change their Data Provider Terms at any time without giving you notice, so please check them each time you visit the Catalogue.
In the context of the agreement between you and the Condamine Alliance that these Terms of Use represent:
Condamine Alliance - means the Condamine Catchment Natural Resource Management Corporation Ltd (trading as Condamine Alliance), as the legal entity representing and responsible for the Catalogue.
You/user - means you as a website user, Content/Data user, or Content/Data provider. In most cases you will be a representative of an organisation or group. In some cases you may be a personal user.
Data provider - means an individual or organisation that makes Content available on or via the Catalogue.
The Catalogue - means this website with the URL http://metadatasearch.condaminealliance.com.au/ (or any URL replacing it or containing it within the URL) and associated web services, internet publishing tools, software, tools, etc.
Content - means contributions or content; includes, but is not limited to, documents, information, records, photos, images, contact details. Content may also include or be referred to as Data as the context requires or as set out in a Data Provider Agreement.
In order to submit Content to the Catalogue you are required to register to establish an account/contributor profile with the Catalogue.
When you register, you are registering as a user of the Catalogue who is a representative of an organisation or group. In some cases you may register as a personal user of the Catalogue. Access to registration areas is by your email address and password. Your contribution to/use of the Catalogue is an agreement to abide by our Terms of Use.
We allow you access to the registration areas of the Catalogue on the basis that:
In some cases the Condamine Alliance may ask you to provide your real name or other identifying or contact details - such personal information will be managed in accordance with the Condamine Alliance Privacy Policy.
You will ensure that any registration information you give to the Condamine Alliance is accurate, correct and up to date.
The Condamine Alliance will not accept a registration that the Condamine Alliance suspects is being made by or on behalf of someone who has been suspended for violation of these Terms of Use.
You are responsible for maintaining the confidentiality and security of your password(s). You are therefore responsible for everything done or submitted using your account.
If you become aware of any unauthorised use of your account, you should notify the Condamine Alliance immediately on office@condaminealliance.com.au
If, for any reason, we believe you have not complied with these requirements, we may, at our discretion, lock, restrict and/or cancel your access to the registration areas of the Catalogue immediately and without notice.
The Catalogue only publishes Content submitted by registered contributors. The Condamine Alliance accepts no liability in respect of any Content submitted by contributors and published by us, and we are not responsible for its content and accuracy.
You retain copyright and any other rights you already hold in Content which you submit, post, display, upload etc. to the Catalogue
You are free to make available, use or publish your Content elsewhere.
You warrant that you own or created the original Content or have the necessary rights, licenses or permissions to make the Content available in the Catalogue.
You will make reasonable efforts to ensure your Content is accurate at the time you collected or created it or made it available in the Catalogue.
The use of Content you contribute to the Condamine Alliance via the Catalogue is granted to the Condamine Alliance and the Catalogue users on the basis of a non-exclusive, worldwide, free, perpetual, irrevocable licence to:
a) reproduce, copy, store, cache, manage, display, publish, distribute, use, reproduce, adapt, modify, make derivatives, change into other formats and incorporate it into other works or collections
b) make available the Content and derivatives in accordance with the Catalogue Terms.
Note in some cases Content may be in the public domain, in the sense that it is not subject to copyright protection because copyright has expired or it does not qualify for copyright, eg ideas, facts, names, styles, titles, slogans. Neither you nor the Condamine Alliance will seek to assert any intellectual property rights over this public domain Content. The Condamine Alliance and data users will be free to use such public domain Content in any way, although attribution where appropriate is appreciated.
Any member of the public is able to view the Catalogue contents without the need to register as a contributor.

This Catalogue and its Content are protected by copyright law. Copyright in this material resides with the Condamine Alliance or various other data providers as indicated.
Any unauthorised use of the materials contained in the Catalogue is prohibited. No part of this work may be reproduced, stored in a retrieval system, communicated or transmitted in any form by any means electronic, mechanical, photocopying, recording or otherwise without prior permission.

To the fullest extent permitted by applicable law, the Condamine Alliance (including its employees and contractors), the Commonwealth of Australia and data providers exclude all liability to any person for any consequences, including but not limited to all losses, damages (including indirect, special or consequential damages, loss of business, revenue/profit, loss of time etc), costs, expenses and any other compensation, arising directly or indirectly from your use of the Catalogue or Content or inability to access the Catalogue or associated Content.
If you find any inaccurate, out of date or incomplete Content in the Catalogue, or if you suspect that something is an infringement of intellectual property rights, you must let us know immediately by contacting office@condaminealliance.com.au or the data provider of the Content.
Our Privacy Policy also forms part of the Condamine Alliance Terms of Use and it describes how we use your personal information when you use the Catalogue.
